Navigating Iowa’s New Hemp Law Amid Legal Challenges

Iowa’s recently enacted hemp law has come into force, sparking immediate legal disputes just days after its implementation. This development follows a federal judge’s decision to deny an initial lawsuit seeking to limit enforcement of stringent THC restrictions on consumable hemp products.

Court Denial and Initial Challenge

Last Friday, a U.S. district judge for the Southern District of Iowa dismissed a plea from two THC drink manufacturers to curtail the enforcement of Iowa’s new law. The statute mandates THC limits of 4 milligrams per serving and 10 milligrams per container, alongside a requirement for warning labels on such products. Simultaneously, a coalition of eight Iowa hemp businesses filed a second lawsuit challenging the constitutionality of House File 2605 (HF 2605) and another regulatory statute, HF 2641. Plaintiffs and Allegations

The plaintiffs in this second lawsuit include a diverse array of businesses such as American Shaman, Beyond CBD, Campbell’s Nutrition Centers, Greene Goods Market and Greenhouses, HW Premium CBD, Icanna CBD, Sky High, and Your CBD Store. They argue that the state’s delayed finalization of regulatory details until mid-July places them in a state of “regulatory limbo,” rendering them non-compliant with the new law despite its recent enactment, as reported by the Iowa Capital Dispatch.
